Man charged in Milton fatal shooting released on $130k bail

The man accused of second-degree murder in the fatal shooting of a home intruder in Milton has been released on a $130,000 bail.

Jag Virk, the lawyer representing the accused, confirmed to CHCH News that the Superior Court Justice Bruce Durno consented to Ali Mian’s release.

As a condition of his release, Mian must live with his grandmother, he must also surrender his passport and firearm licence to Halton police.

Officers were called to a home on Gibson Crescent around 5 a.m. on Feb. 19 for a report of gunshots.

Police say a group of suspects intended on robbing the house. Mian confronted the suspects and gunshots were fired within the home.

Three of the five suspects fled the scene in a light-coloured Dodge Charger with a sunroof and black wheels.

Ali Mian, 22, of Milton has been charged with one count of second-degree murder.

According to the lawyer, Mian’s intention was not to kill the intruder as he only shot at him once. Mian is a registered firearm owner and used his gun legally against an armed intruder.

Virk also says that Mian should have never been charged with murder for protecting his mother from someone that broke into his home.

Evidence heard during Thursday’s court proceeding is under publication ban.

Romario Clarke, 20, of Oshawa is facing one count of break and enter, and another count of unauthorized possession of a firearm.

On Feb. 24, investigators identified the victim as Alexander Amoroso-Leacock of Toronto.

Halton police say the victim was scheduled to be released from hospital Thursday night. He sustained serious injuries, which required stitches to the face and upper body.

Officers say Mian is scheduled to appear in a Milton courthouse on March 16.
