On October 3, 2023, emergency crews responded to reports of gunshots in the area of 111 Herkimer St. in Hamilton where they found Tito Kelly, a 36-year-old man, dead.

Detectives say this was an isolated incident involving a drug transaction where both parties exchanged gunfire.

Earlier in July, police announced the arrest of Donte Smith in connection to the manslaughter and was held in custody after his bail was denied at a hearing on July 11.

Hyseni was injured during the shooting and was transported to hospital where he received treatment and was later released.
