It was a victory in court for the crown today in the trail of the man accused in the Skyway bridge crash.
Sukhvinder Singh Rai’s lawyer David Locke presented a charter of rights and freedoms article to suggest that a portion of the evidence on the dangerous driving charge be excluded. Today a judge denied the request. That piece of evidence is the OPP smelling alcohol on Rai’s breath while he was in the backseat of the cop car.
The defence wanted the evidence excluded because Rai wasn’t advised of his rights while he sat in the police car moments after the crash that closed the Skyway for days and caused more than a million dollars damage.
Defence attorney David Locke said “if he’s not a suspect of a crime he shouldn’t have been in the car.”
Judge Fred Campling replied “where should he have been?”
Locke said “he should have been off the bridge at the police station where he could talk to a lawyer.”
In the end the judge ruled in the crowns favour allowing what he called an important piece of evidence to remain as part of the trial.
