Hamilton Waterfront Trust terminates Sarcoa’s lease

Hanging on the front of the waterfront restaurant’s door is a termination notice that was served Thursday. It reads the subtenant of Sarcoa has failed to pay hundreds of thousands in rent, among a number of other breaches.

The Hamilton Waterfront Trust, which leases the property to Sarcoa, terminated the restaurant’s lease. The notice of termination reads the tenants failed to pay a total rent of over $226,000, failed to be open during the same hours and days as the majority of restaurants in the Golden Horseshoe and operated as a banquet hall on more than an occasional basis without the consent of the tenant.

Since 2015 the waterfront restaurant and patio has been in a $15 million legal battle with the Hamilton Waterfront Trust and the city. This came after a noise by-law prevented the eatery from throwing patio parties with loud music. It wasn’t until last year that the venue brought back music on the patio in an attempt to save its dwindling business.

Sarcoa’s lawyer released a statement to CHCH news saying, “We are hopeful we will be able to resolve the issue in a short manner and we are hopeful that all scheduled events will proceed uninterrupted.”
