The Hamilton Police Services board will not challenge the temporary appointment of Councilor Lloyd Ferguson.

Ferguson was appointed by council two weeks ago to replace Councillor Terry Whitehead. At that time a member of the Ministry of Community Safety said the appointment was unlawful. That was echoed by the board, forcing a recent meeting to be cancelled.

In an e-mail to its members, a board lawyer says she believes Ferguson’s appointment to be legal. Ferguson’s appointment will last until an investigation can be completed into the suspension of Councilor Terry Whitehead over his conduct.
