A first-degree murder trial continuing in Hamilton today, 49-year-old Lou Malone was killed by a shotgun blast to the back of his head back in 2013.

The day started off with testimony from Lou Malone’s girlfriend. She said the 2 of them fought before Malone walked off with his 2 pitbulls on leashes, and then she saw a pickup truck suddenly appear on the street and pull up to Malone. She saw an altercation and she saw Malone fall briefly to the ground.

The jury has seen surveillance footage of Malone running down the street followed by a pickup truck, and they’ve heard from many witnesses who heard and saw someone shooting from the passenger window of a truck sometime after 1 a.m on November 9th, 2013.

Malone and the truck were seen all over the area of Cannon, Brittania and Kenilworth, until Malone was ultimately cornered and shot in the back of the head at close range in front of a store on Kenilworth.

Court has heard that Mike Josipovic was beaten up by Malone and another man earlier that same night outside a Main Street pool hall.

Today the jury heard cell phone evidence that shows Josipovic called his brother from a 7-11. The 2 lived side by side in houses in Grimsby, and at the time John Josipovic was still in Grimsby.

The records show John left Grimsby after the call and travelled to Hamilton where Mike was waiting.

The records also show several phone conversations between Mike Josipovic and the victim, until minutes before Malone was attacked.

A truck matching the one seen by witnesses was found when police searched John Josipovic’s garage.

The trial resumes tomorrow.
