Hamilton man who spat on Tim Horton’s drive-thru employee gets discharge with probation

A Hamilton man charged for spitting on a Tim Horton’s drive-thru employee was granted a discharge with probation.

Darren Dickison was charged with assault and mischief under $5,000 after an incident from March 2020.

The 52-year-old was upset he could not use a paper roll up the rim winner to pay for his coffee, according to an agreed statement of facts read in court on Friday.

He was told he had to use the coffee chain’s app.

“This is the worst thing that has happened. I don’t know what happened that day and I regret it ever since,” he said in court.

The court heard he’s been taking anger management classes and medication since the incident.

The judge granted a discharge with 12-month probation. He is also not allowed to go to the Tim Hortons location where it happened.
