Fort Erie man, 38, arrested after altercation at Pen Centre

A 38-year-old man is facing charges after he allegedly drove a vehicle while impaired and then assaulted a security guard.

Niagara Regional police officers were called to the Pen Centre on Glendale Ave. on Nov. 30.

A security guard had suffered minor injuries while attempting to apprehend a man who was allegedly driving while impaired.

Dustin Picov, of Fort Erie, was arrested and charged with assault, uttering threats, assault with intent to resist arrest, causing a disturbance, dangerous operation of a motor vehicle and failing to leave private property when directed.

“Police reviewed CCTV footage from the Pen Centre at which time it was determined that security personnel acted within their legal authority and did not exercise excessive force,” said Niagara Police in a news release.

Investigators say they believe several people witnessed the altercation and are asking anyone who wishes to provide police with footage of the incident to contact Det. Chris Morin at 905-688-4111, ext. 39671.
