Today Dakota Hart appealed to the Ontario review board to be released from the maximum security forensic psychiatry ward at St. Joseph’s Healthcare Hamilton’s West 5th campus. Last fall Hart was found not criminally responsible for abducting a child from a Hamilton school.
A judge found him not criminally responsible for taking a boy from the playground of Earl Kitchener elementary school last fall.
The boy was able to run away back towards his school. Hart says he doesn’t remember what happened. only that he was walking down the street and quote “this crime happened.”
Doctors say we may never know his motive.
The crown and a lawyer for the hospital want Hart to remain in the highest level of security with no privileges at the West 5 campus.
Hart seemed very relaxed inside the hearing. He was wearing a pair of jeans and a blue fitted t-shirt and sneakers. When the board was being introduced, he leaned back in his chair and removed his shoes and put his one leg up almost like he was sitting in his own living room.
Hart told the board which includes a psychiatrist, psychologist, a legal expert and a civilian member that his mental state is 100% better, but he refuses treatment and won’t take any medication for his bi polar disorder. He even stopped taking his HIV drugs for a short time as what the doctor called a dramatic gesture.
Hart says he doesn’t want to be experimented on to placate the system.
Hart is openly gay and is also asking to be transferred to the centre for addiction and mental health in Toronto because he says that city has a larger gay population.
A ruling is not expected for another two weeks.
