The 5th day of cross examination took place during a rare Friday testimony in the Tim Bosma murder trial. The court heard that Mark Smich is a clever and manipulative killer who erased his tracks so well that there is hardly any physical evidence linking him to Bosma’s murder. At least, that’s how Dellen Millard’s lawyer painted the co-accused at the trial as he wrapped up his cross examination today. However, Smich stuck to his version of the events that led to Bosma’s death.

Yesterday Sachak told the jury, through cross examination, what his client says happened. That Smich pulled out a gun while they were on the highway and said, “we’re taking this truck.” Millard allegedly said “oh no,” and Tim Bosma, according to Millard, grabbed for the gun causing it to go off. According to his lawyer, Dellen Millard was furious at Mark Smich for shooting Tim Bosma.

After it happened they picked up the Eliminator from Millard’s farm and brought it to his hangar, towing Bosma’s body inside the incinerator, behind his own truck with the Yukon following behind. At about 12:45am, Millard’s Yukon leaves the hangar and doesn’t come back for half an hour. Smich says Millard went to get gas but Sachak says he had to leave to cool off after an argument about Tim Bosma’s murder.

Smich and Millard were caught on camera walking through the hangar shortly after Millard returned in the Yukon. Prosecutors believe they spent the rest of the night burning Bosma’s body and ripping the evidence out of his truck.

Previously, Smich has testified that he was scared and confused in the days following the murder but Sachak says that’s a lie. Smich had all the drugs at Millard’s home brought to him after Millard’s arrest as well as the gun, although Smich says he was surprised by that. He then tried to sell the weapon, he hid it in a washing machine in his mother’s garage and finally wrapped it in tape and buried it in the woods. It has not been found.

Smich cancelled his phone days after Millard’s arrest and SIM cards were missing from his devices, so police couldn’t extract information from them. Smich’s last words to his girlfriend, Marlena Meneses, when they were both being arrested on May 22nd were “Don’t tell them anything, Babe.” Sachak then put up photos of Smich and Meneses at his sister’s wedding, shortly before that arrest, showing Smich smiling and having a good time. “That’s you, in a state of confusion and paranoia, 13 days after Mr. Bosma was shot.”
