Mark Smich’s story about what happened to Tim Bosma on May 6th 2013, was put under close scrutiny in a Hamilton courtroom today. Smich spent a third full day under cross examination by the lawyer of his co-accused, Dellen Millard.

Today the cross examination sounded a little different. It seemed like Millard’s lawyer, Nadir Sachak was speaking slower and getting less worked up than yesterday, when a lot of people had the impression that Smich was getting the upper hand.

Smich has 7 convictions on his criminal record, most recently for graffiti and six years ago drunk driving. Although he has never had a drivers’ licence, he told the court.

Sachak says Smich was helping Millard steal the truck because he expected to get a big payoff after in the form of Millard’s Cadillac, though Smich disagreed. Then he took Smich to the story of what happened May 6, when they parked the Yukon at the corner of Book and Trinity roads and walked to the Bosma house. This was so the Yukon wouldn’t be identified and Smich agreed. However, Millard didn’t cover his face or tattoos.

“He’s been planning this mission for a year,” Sachak says, “It doesn’t make sense.” If Millard wanted this diesel truck so badly, why ruin it with a bullet hole and blood? Smich said he also thought it odd that Millard planned the test drive at night.

“Dell does strange things all the time,” Smich said. He claimed he didn’t piece together what was happening until it was too late.

Sachak finished his cross examination today by saying, “all three of you were in that truck when Mr. Bosma was shot.” Smich disagreed.

He’s back here for a fourth day of cross examination by Sachak. The crown likely won’t get to question him until Friday, as the judge has indicated that court will sit on Fridays now that the evidence is mostly in.
