Court heard in testimony at the Tim Bosma murder trial that Dellen Millard and Mark Smich both had friends who would do whatever they requested, regardless of legality. First we heard more cross examination of one of Mark Smich’s close friends from 2013, Brendan Daly and we heard that Daly was intimidated by Smich, an aspiring rap star who made him uncomfortable with violent conversations.
Brendan Daly told the court his friend Mark Smich was always aggravated and had a mean and violent streak in him. The two were Oakville neighbours who hung out every day to smoke weed and drink beer. Daly said he got nervous when Smich started talking about violent things. The jury heard Smich’s ipad was full of rap lyrics talking about guns like, “my 380 is no stranger when I’m angered you’re in danger.” The crown believes Tim Bosma was killed by a Walther 380 pistol. It wasn’t found.
After Dellen Millard’s arrest, Smich became paranoid, Daly said, especially about a yellow toolbox hidden in his mother’s house. Daly knew it carried a gun. Smich moved into his girlfriend’s place until, he said, he got rid of the evidence. Daly says Smich was terrified Millard would frame him for Tim Bosma’s murder. He denied even being there for the crime.
A childhood friend of Dellen Millard’s testified next. Matt Hagerman is five years younger but they regularly spent time together. Millard would ask him to help in so-called missions, but he says he only participated once. In the middle of the night, he was a lookout when they stole a Bobcat machine, it was recovered in the Millard hangar after his arrest.
Shortly before that arrest, Millard handed off the yellow toolbox to Hagerman, it was padlocked. Hagerman’s voice was breaking in his testimony and he was wiping away tears when in the hallway. We heard he broke off a relationship with another mutual friend Andrew Michalski after May of 2013 because of quote lies to do with this case. But Hagerman also admitted he lied to police three times before getting advice from a lawyer and coming clean.
Hagerman is back on the stand in the morning and we expect to hear from Michalski soon too.
