They’re grown up now, but they were just kids when they discovered Diane Werendowicz dead, under a tire in a stream near their east Hamilton homes. That was 35 years ago. Today, John Temple and Jerry Wallace testified at the Robert Badgerow murder trial in Kitchener.
“Female, face down, still clothes on the body, a tire nearby,” Wallace recited to the court from his memory. After, he ran to tell his mom, but she didn’t believe him until she heard the sirens. By Monday morning when they were all back in school, they knew from news reports that Werendowicz had been raped and strangled.
A forensic biologist testified today that Badgerow’s sperm was found inside Werendowicz and inside the crotch of her jeans which she was wearing, but not on her underwear, which was found on the bank. Yesterday, Badgerow’s lawyer suggested that his client had consensual sex with Werendowicz after she left the bar that night and that she was killed by someone else when she walked home afterwards without putting her underwear back on.
All that the now-retired expert from the centre of forensic sciences could say for sure today, was that the two did have sex within 12 hours of her death.
