Ancaster doctor in St. Lucia court today

Sahad Jamshidi was in a St. Lucia courtroom today, waiting to hear if his case would go to trial. The Ancaster man is charged with gross negligence causing death.

His attorney, Alberton Richelieu told CHCH that his team just received evidence for the first time and asked that the hearing be ajourned until next Thursday when he will respond to the submission made by the crown. Two things can happen in court that day. The judge could regard the evidence as sufficient and start the pre-trial process, which could take months. Or the judge could say there isn’t enough evidence and throw out the case, allowing Mr. Jamshidi to return home. The latter is what Richilieu and his team are working towards.

Jamshidi has been charged with gross negligence causing death in the death of 4- year old T.J. Elibox. Police allege that the boy drowned after Jamshidi took him onto his kite board without his parents permission. However, the Ancaster native – who attended medical school in St. Lucia and was on vacation visiting friends – claims that he was on his kite board when he noticed the boy drowning in rough waters. If convicted, Jamshidi could be behind bars for life.

The attorney also told CHCH that his client should be thankful that the case is in St Lucia and not other Caribbean countries like St. Vincent or Dominica, where the preliminary trials could last anywhere between two to three years.
