Update:
Constable James Forcillo found NOT guilty on 2nd degree murder, NOT guilty on Manslaughter. GUILTY on attempted murder.
It was day 3 of jury deliberations at the second degree murder trial of Toronto police officer James Forcillo, and there’s still no verdict. The jury is taking their time, because there is a lot to consider here including five possible verdicts.
This all dates back to a 50 second encounter on July 27th, 2013 when Constable James Forcillo shot and killed Sammy Yatim who was holding a knife on a Toronto street car. There were a total of 9 shots fired from Forcillo’s gun.
The murder charge relates to the first 3 shots, one of those bullets struck Yatim in the heart and killed him. The jury must decide if Forcillo was acting in self defence when those shots were taken. The attempted murder charge relates to the second group of shots where Forcillo shot Yatim 5 more times.
Forcillo did testify in his own defence and said that he believed Yatim was trying to lunge at him, and that Yatim was trying to get back up when Forcillo shot again. But that is in the hands of this 11 person jury who, if they convict, will be the first to convict a Toronto police officer for an on the job shooting.
They will continue through the weekend or until they have a verdict.
