Binbrook man to stand trial again for second-degree murder

Ontario’s top court has quashed the acquittal of a Binbrook homeowner who shot an unarmed Indigenous man in his driveway trying to break-in to his truck.
In a unanimous decision, the Court of Appeal found the trial judge was wrong in instructing the jury that acquitted Peter Khill in June 2018. The ruling means that Peter Khill will have to stand trial again for second-degree murder.
Khill had argued self-defence in shooting Jon Styres in 2016. Khill’s defence said that he saw Styres breaking into his truck in the middle of the night and he fell back on his four years of army reserve training.
The Appeal Court said the trial judge made an error in instructing the jury.
Michael Lacy, Khill’s lawyer says, “Peter Khill has consistently maintained that he was acting in self-defence and was not guilty of any crime. We are carefully reviewing the Court’s decision and considering next steps including an application for leave to appeal to the Supreme Court of Canada.”
