Hamilton staff disagree with court ruling

The head of Hamilton’s public works department says he doesn’t agree with a recent court ruling that awarded a woman $192,000 after finding the city guilty of neglecting to monitor its sidewalks.

Blanch Worthy, 89, spent six weeks in hospital with a broken hip and wrist after falling on an uneven city sidewalk in September 2012.

The court found that while the city could provide documents of sidewalk inspections in the years leading up to and after the her fall, it was unable to provide documents for any inspections conducted in 2012.

Public works manager Gerry Davis says he’s checking again for the 2012 records, because he doesn’t think it makes sense that they would have skipped an inspection in 2012.

The court also found problems with the equipment used to inspect city sidewalks, and with the credibility of a staff witness.
