Final arguments heard in Canada Post court case in Hamilton

The judge overseeing a court case involving Hamilton and Canada Post challenged the city’s argument today that it has jurisdiction over where super mailboxes should be installed.
Donna Skelly has more on the final day of arguments in this case.
Justice Alan Whitten challenged the city’s lawyer pointing out that the process to determine where super mailboxes should be installed, was working until Hamilton passed a new bylaw in April. Justice Whitten also disputed the city’s claim that Canada Post was unwilling to work with the city to find suitable locations for new mailboxes. Right from the beginning of the three day trial, Whitten has taken a tough stand with the city stating this is not a political excercise about the cancellation of door-to-door delivery.
The super boxes have been in the city for over 30 years but a recently passed bylaw would require the crown corporation to seek a permit before installing any more.
At least one positive outcome from the city taking Canada Post to court is that Canada Post has relocated at least 30% of their mailboxes after listening to complaints from local homeowners.
Judge Whitten is expected to announce his decision next week.
